Registration of Shops and Establishment

Checklist:

  • A duly filled up application form “O” in (duplicate for manual submission) signed by the Employer or the Authorized signatory. Signature is required only for manual submission.
  • A xerox copy of the Trade license issued by the local authorities.
  • A xerox copy of the registered partnership deed in the case of a partnership Firm/Establishment.
  • Attested copies of the appointment letter (s) in Form G issued to each of the permanent, temporary, casual, probationer, learner employees.
  • The original copy of the Treasury Challan depositing the requisite amount of fees as specified in Schedule I in the specified Head of Account or through the “e-Payment” when it is notified and functioning.

An Act to regulate the conditions of work and employment in shops and commercial establishment and also to the establishments for public entertainment or amusement in the state of Assam.

Rules 45- Registration of establishment and application for registration.

Within thirty days from the date of enforcement of these rules in case of an establishment existing on that and within thirty days from the date of commencement of the business in the case of new establishment the employer of every establishment shall apply for registration under the Act the Chief Inspector or the authorized by him in this behalf in form ‘O’ prescribed for the purpose in (duplicate for manual submission) and in print together with the original copy of the treasury challan depositing the requisite amount of fees specified in Schedule- I:

Description of the Process

The process flow consists of five (5) steps viz-
Steps 1:- The business entrepreneur (applicant) shall get ready according to the check lists.
Steps 2:- Fill up Form ‘O’ in (duplicate for manual submission) according to the guidelines which is available in the Department Office/Website
Steps 3:- The filled up application completed in all respect and the prescribed fees deposited either through treasury challan in the specified head of account in the Govt. Treasury or through “e-payment” along with the required documents are to be submitted to the ‘Facilator’ or the Registering authority.
Steps 4:- Submitted Form and documents are verified by the Registering Officer and are officially processed.
Steps 5:- (a) If the applications is found to be correct in all respect than the application is accepted and a Certificate of Registration is issued to the applicant.
(b) If the application is found to be incomplete/incorrect, than the application is rejected with a reasoned reply to the applicant.

Eligibility Criteria:

Any entrepreneur/applicant should have the trade license issued by the relevant authority and other documents ready according to the checklists in order to apply for Registration under the Assam Shops and Establishment Act, 1971.

Guidelines for Filing up the form

a. The relevant information in Form “O” in (duplicate for manual submission) is to be filled up in Block Letters with Black Ink or do online submission of Form “O”.
b. List of Directors / Partners should be stated in the Form “O” or in the letter head signed by Employer or the Authorized Signatory and annexed along with Form ‘O’. Signature is required only for manual submission of application Form.
c. List of Permanent / Casual / Temporary / Probationer / Contractual should be stated in the Form ‘O’ or in the Letter Head signed by the Employer or by the Authorized Signatory and annexed along with Form ‘O’. Signature is required only for manual submission of application Form.
d. Initiation date of Business should be according to the date mentioned in the Trade License issued by the Competent Authority.
e. The application for Registration of a new establishment should be done within 30 days from the commencement of the business.

Important Timeline

  • After verification, if the application is found to be correct in all respect than the certificate of registration is to be issued within 15 days from the date of receipt of the applications.
  • If the applications is found to be incorrect than rejection with reasoned reply to be issued within 15 days.
