Who is an Employee?

Employee means a person, who is-
- A railway servant as defined in clause (34) of section 2 of the Railways Act, 1989 (24 of 1989), not permanently employed my any administrative district or sub-divisional office of a railway and not employed in any such capacity as is specified Schedule II; or
- A master, seaman or other members of the crew of a ship
A captain or other member of the crew of an aircraft,
A person recruited as driver, helper, mechanic, cleaner or in any other capacity in connection with a motor vehicle.
A person may be regarded as workman within the meaning of this Act and the following conditions must be fulfilled :
- The person concerned must be in the employment regular or otherwise.
- The person concerned to be a workman must be a railway servant as defined in clause (34) of Section 2 of the Railways Act, 1989, but persons who are permanently employed in administrative, direct or sub-divisional office of a railway are excluded from the definition of the workman. The persons who are railway servants but are not employed in any such capacity as is specified in Schedule II are also excluded from the definition of workman.
- The person concerned must be employed in any such capacity as specified in Schedule II.
