Process for Licensing under Contract Labour Act

Overview

An Act to regulate the employment of contract labour in certain establishment and to provide for its abolition in certain circumstances and matters connected therewith. It applies

a. To every contractor who employs or who employed on any day of the preceding twelve months fifty or more workmen.

b. It shall not apply to establishments in which work only of an intermittent or casual nature is performed.

Grant of license: Every application for the grant of license under sub-section (1) of section 12 shall be made in the EODB Portal and shall contain the particulars regarding the location of the establishment, the nature of process, operation or work for which contract labour is to be employed and such other particulars as may be prescribed.

Eligibility Criteria:

Any entrepreneur/applicant should possess the contractual agreement with the Principal Employer and Form V authorization before applying for the license.
If the entrepreneur/applicant engages fifty (50) or more contractual workers in the contractual work.

Rule 24 Security - (1) Before a license is issued, and amount calculated at the rate of Rs. 300.00 for each of the workman to be employed as contract labour, in respect of which the application for license has been made, shall be deposited by the contractor for due performance of the conditions of the license and compliance with the provisions of the Act or the rules made thereunder :

Rule 26. Fees – (2) The fees to be paid for grant of license under Section 12 shall be as specified below:-
If the number of workmen employed by the contractor on any day-

(b) exceeds 10 but does not exceed 20 Rs. 300.00
(c) exceeds 20 but does not exceed 50 Rs. 500.00
(d) exceeds 50 but does not exceed 100 Rs. 700.00
(e) exceeds 100 but does not exceed 200 Rs. 900.00
(f) exceeds 200 but does not exceed 300 Rs. 1100.00
(g) exceeds 300 but does not exceed 400 Rs. 1600.00
(h) exceeds 400 Rs. 2100.00
